विवादित व्यक्तिहरुलाई सार्वजनिक पदमा नियुक्ति नगर ।
नेपाल सरकार, संवैधानिक परिषद् तथा राज्यका विभिन्न जिम्मेवार तहबाट कार्यपालिका, संवैधानिक निकाय तथा विभिन्न सार्वजनिक निकायका उच्च पदहरुमा फौजदारीलगायत विभिन्न अभियोगमा राज्यको कारबाही तथा छानविन प्रक्रियामा रहेका एवम् सामाजिक र नैतिक रुपमा विवादित व्यक्तिहरुलाई नियुक्ति सिफारिस गरेको र नियुक्ति गर्ने क्रममा रहेको जानकारी आयोगलाई प्राप्त भएको अवस्थाप्रति राष्ट्रिय मानव अधिकार आयोगको गम्भीर ध्यानाकर्षण भएको छ ।
राज्यका निकायमा नियुक्ति हुने व्यक्तिहरु सामाजिक रुपमा स्वच्छ छवि भएको, विवादरहित, उच्च नैतिक चरित्र भएको र कानूनी रुपमा फौजदारी अभियोगमा सजाय नभएको हुनुपर्दछ भन्ने लोकतन्त्रको आधारभूत मान्यता, सभ्य समाजको अपेक्षा र सार्वजनिक सरोकारको विषय हो । पदीय जिम्मेवारी अनुसारको योग्यता र क्षमता वस्तुगत आधारमा यकिन गरेर मात्र योग्यतम व्यक्तिलाई राज्यका निकायमा नियुक्त गर्नुपर्दछ भनी सर्वोच्च अदालतबाट (ने.का.प. २०७३ फागुन, भाग ५८, निर्णय नं. ९७१०) मा परमादेश समेत जारी भएको छ । सामाजिक र कानूनी रुपमा विवादित व्यक्तिहरुलाई नियुक्त गर्ने कार्य कानूनी शासनको विपरीत हुने र यसबाट दण्डहीनतालाई प्रश्रय पुग्नुका साथै राज्यका निकायप्रति आमनागरिकको भरोसा समेत टुट्न जान्छ ।
अत ः लोकतन्त्रको भावना र संविधानको मर्म विपरीत हुने गरी विभिन्न विषयमा विवादमा आएका व्यक्तिहरुलाई सार्वजनिक निकायमा नियुक्ति नगर्न/नगराउन आयोग नेपाल सरकारलगायत सम्बन्धित निकायलाई निर्देशन गर्दछ ।

The National Human Rights Commission has drawn serious attention to a situation where it has received information that the Government of Nepal is recommending or in the process of recommending individuals who are implicated in various allegations related to criminal cases, abuse of state power, misconduct, and ethical controversies, and under investigation by the state as well as those controversial in social and moral terms, for appointment to high positions in the executive, constitutional bodies, and various public entities.
It is a fundamental principle of democracy, expected by civilized society and essential for public trust in governance, that individuals appointed to state institutions must have a clean public image, be free from controversy, possess high moral character, and have not been convicted in criminal cases by law. In line with this principle, the Supreme Court has also issued a mandamus in 2073 (NKP 2073 Falgun, Part 58, Decision no. 9710) that only those individuals who are deemed qualified and competent based on the requirements of the respective positions are to be appointed to state bodies. The appointment of controversial individuals in social and legal terms contravenes the principles of rule of law, enhances impunity and jeopardizes public trust in state institutions
Therefore, the Commission directs relevant bodies, such as the Government of Nepal, to refrain from appointing individuals involved in various controversies in public institutions, in order to uphold the essence of democracy and constitutional values.
